Shipping and Delivery Policy – Underground Shelter Systems

This Shipping and Delivery Policy (“Policy”) governs the shipment, delivery, and logistics of underground shelter systems and associated products (“Products”) supplied by [Your Company Name] (“Company”) to the purchaser (“Customer”).


1. Nature of Shipping

The Customer acknowledges and agrees that:

  • All Products are manufactured, sourced, and/or assembled internationally;

  • Shipping involves multi-stage logistics, including production scheduling, international freight, customs clearance, and local transportation;

  • As such, delivery timelines are indicative only and subject to variation.


2. Estimated Timelines

Any delivery or shipping timelines provided by the Company:

  • Are estimates only based on current production and logistics schedules;

  • Shall not be construed as fixed, guaranteed, or binding deadlines;

  • May vary due to manufacturing queues, shipping availability, and external conditions.

The Customer expressly agrees that time shall not be of the essence in relation to delivery.


3. Factors Affecting Delivery

Delivery timelines may be impacted by, including but not limited to:

  • Manufacturing schedules and production capacity;

  • Availability of raw materials or components;

  • International shipping schedules and carrier availability;

  • Customs inspections, clearance procedures, and regulatory approvals;

  • Port congestion, delays, or rerouting;

  • Weather conditions or force majeure events;

  • Site readiness and accessibility at the delivery location.


4. Communication of Status

The Company shall:

  • Provide periodic updates regarding order status and expected delivery timelines;

  • Notify the Customer of any material changes or delays as reasonably practicable.

Such communication shall be considered fulfillment of the Company’s obligation regarding delivery updates.


5. No Liability for Delays

To the fullest extent permitted by law:

  • The Company shall not be liable for any delays in shipping or delivery arising from the factors listed above;

  • Delays shall not entitle the Customer to:

    • Cancel the order;

    • Claim refunds;

    • Impose penalties or liquidated damages.


6. Partial Shipments

The Company reserves the right to:

  • Deliver Products in partial shipments;

  • Invoice separately for completed stages or delivered components.


7. Delivery and Offloading

Unless otherwise agreed in writing:

  • Delivery shall be made to the nearest accessible point at the Customer’s site;

  • The Customer is responsible for:

    • Offloading;

    • Handling equipment (e.g., cranes, forklifts);

    • Site access and readiness.

Any delays at site during delivery may result in additional charges.


8. Risk Transfer

  • Risk of loss or damage shall transfer to the Customer upon delivery at site or designated location;

  • The Customer shall be responsible for ensuring appropriate storage and protection thereafter.


9. Storage and Demurrage

If delivery is delayed due to Customer-related reasons, including site unavailability:

  • The Company reserves the right to:

    • Charge storage fees;

    • Recover demurrage, detention, or re-delivery costs.


10. Inspection Upon Delivery

The Customer shall:

  • Inspect the Products upon delivery;

  • Report any visible damage or discrepancies immediately.

Failure to do so shall constitute acceptance of delivery in good condition.


11. Force Majeure

The Company shall not be responsible for delays or failure in delivery due to events beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Government restrictions;

  • War, strikes, or pandemics;

  • Global supply chain disruptions.


12. Policy Integration

This Policy shall be read in conjunction with the Company’s:

  • Terms of Service;

  • Return, Refund and Acceptance Policy.

In case of conflict, the Company’s interpretation shall prevail.
